E.S.A advice needed.

I'm wondering if someone could offer me some helpful advice please. I am currently in the process of a claim for E.S.A, I have been waiting for 3 weeks to hear from them and in that time I have only recieved £57.04p in crisis loans. I phoned them again this morning as I was told to ring them and ask for an emergency payment, however once I rang them I was told that my claim was with a decision maker as I had a disallowed claim for E.S.A within 6 months. Now my problem is this, I have not had a disallowed claim within 6 months(my previous claim for E.S.A ran out at the end of January and I then signed back on to J.S.A) and I have not failed a medical as I have not attended, or been requested to attend one this year. Does anyone have any advice to which they can give me because despite me stating otherwise the DWP will not accept that I have not had a disallowed claim or failed a medical.

  • I'd ring them and ask them for the dates they state you had this "non existant" claim for ESA. Could they have muddled up your records with another claimant? Could they send you details in writing as you'd like to see the evidence?

Thanks HorseUnderWater, I am awaiting a phone call back from them now.The only thing that I can think has happened is that a medical that I failed in February 2007(at which Atos's "medical professional" lied through his teeth) has some how been misdated as I know for a 100% fact that I have not had, nor been requested to attend a medical this year. I was signed off from December 2nd 2011 to February 2nd at which time I then signed back on to J.S.A but even then that isn't within the 6 month period for which I have been told I have had a disallowed claim and failed medical.
  • Certainly does seem odd then. I can only think that someone with similar name has been filed into your records.
