bit scary experience, needless summons for council tax

background- I signed on at start of July -

only online option was given, when you call to start a claim, though you then have to go in to jcp a week or so later, to get 'verified' with your ID, supporting docs etc!

The jcp clerk confirmed a claim would be started with local council too, for rent and c/tax. all good so far,,

but despite them confirming claim received by council, cross referenced etc, but i still got reminders, a final demand and a SUMMONS!

Their excuse was that letters etc still go out, until a decision is made?! They have now wasted £100 court fees in a needless case. I take it this will be coming out of the taxpayers budget.

A small rebate is now supposedly due, as i had overpaid while working, though they reckon may take a month or so to arrange?!

I am going to mag court just in case they 'forget' to cancel the case, and was wondering what compo i should ask for?

Their actions seemed totally needless, drawn out, and very stressful.
Long time away from MSE, been dealing real life stuff..

    Not a housing issue but a benefits issue, search the correct board.

    You are liable for council tax and have to pay until your claim for council tax benefit is approved. DO NOT let this go to court, claiming benefits is not an excuse and you will not win the case. Telephone the council now and set up a direct debit, telephone the court and check what is going on at their end. You really should have applied for council tax benefit directly, it's confusing because different parts of the system tell you different things. That way is faster and it actually gets done, going via Jobcente Plus is risky.

    You are not due any compensation, don't be silly.

    Not sure they will have paid £100 court cost at this stage.

    As Firefox has posted above, any council tax payable remains due and collectable until such point as it is paid in full - be this by yourself or via council tax benefit.

    The council can continue to recover any council costs which have been incurred even if council tax benefit has subsequently paid the council tax charge.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
