Advice on Rental Agreements

Hello all,

I'm new on here and have tried searching the forums but can't find what i'm after basically this is my situation...

As far as my landlord is aware i've not been able to shower at home for nearly 3 weeks as the plumber said not to use the bath/shower as it's leaking. Then gave my letting agents a quote for the work that need to be done. (I have been using it but they don't know that, as it doesn't leak if you careful).

They've known about it for 2 and a half weeks and still not had it fixed despite another (different) plumber coming round last week and telling me he can do the job later on that same day. I've paid my rent in full and asked the woman at the letting agency to tell the landlord i don't think i should be charged a full months rent due to me not being able to shower for this time, i just rang her then and she told me i'm not gonig to get any money back whatsoever ?? It's still not even fixed.

Has any one had anything like this before ? Should i persue it further ?? Am i entitled to anything ??

    Contact the landlord directly. Preferably in writing.The details should be in your tenancy agreement.

    Lots of letting agents get a % fee of the rent if they manage the property, so of course they don't want to give you a rent reduction as they themselves get a reduced income.

    Also from now on when you complain about something to the letting agent do it in writing and carbon copy it to the landlord. The landlord may have been made aware of your situation anything from a few days to weeks after you informed the letting agent.
    I'm not cynical I'm realistic :p

  • Thanks, I'm guessing as the lettings agent already said no, then there won't be anything i can do, however i get the impression that she's lying to me. She's already lied once when she was doing a credit check and she said she was still awaiting the details from my employers about me, but i work in an office with 3 people, the person sat next to me is the MD so i know that she did have the details. I think i'm gonig to let this one go as long as the plumber gets here this weekend, but i just like to know where i stand, thanks again olly300 for ther info :)

    In general I think most lease agreements will state that one cannot short pay the rental because a repair hasn't been done. One normally has to give 7/10 days written notice to the Landlord that if the repair isn't seen to, you will have no alternative but to get someone in yourself and send the bill to them. If you cannot bath or shower, let them know that you consider this a violation of health and safety and that they are voilating your right to enjoy the premises as stated in the lease agreement. Refer them to the clause which states that your Landlord will keep the property in good working order and it should also state that they are responsible for the plumbing. Have your letter sent recorded delivery ensuring a signature.

    Very good advice, although I would suggest you inform them that if the repair is not carried out you will get someone in to the same, AND THEN deduct the cost of those repairs from your next months rental payment.

    If the landlord supplied a saucepan and a sponge, they would fulfill the Health and safety gobbledegook.

    I wouldn't send it recorded delivery as rarely is anything good sent by recorded delivery, so they often are returned to sender unopened.

    I would forget about chasing up reduced rent and concentrate on getting the repairs done.
