Distance selling Regs - packaging

The distance selling regs say they make no link between the customer's right to return (within 7 days) and the sellers ability to resell the goods - this in relation to packaging.

3.58: "...You may ask consumers to return goods with the original packaging, but you cannot insist on this."

And

3.48: The DSRs require you to refund any money paid by or on behalf of the consumer in relation to the contract to the person who made the payment. This means the full price of the goods, or deposit or pre-
payment made, including the cost of delivery.

Many companies say they'll deduct up to, say, 20% if the packaging is damaged. Aren't they in breach of the DSR's?

    What goods are you querying?

    Section 1.4 makes it clear that the leaflet is a general guide and not applicable to all situations. The cases I know about are software and personalised items.

    All the companies I deal with for online items i.e. books, clothes just state that the goods need to be packaged up securely ideally in the original packaging.
    I'm not cynical I'm realistic :p

    (If a link I give opens pop ups I won't know I don't use windows)

    Ebay, car-boot and jumble sales? Far be it for me...but seems a bit odd when the DSR's apply to any telephone or on-line purchase - so if I phone up John Lewis and buy a Fridge, they'll be grouped with jumble sales. :)

    Anyway, yes I realize it doesn't apply to consumables and software.

    I was thinking specifically about a fridge freezer, btw.
