I have been mis sold PPI but who do I claim from? .. help !!

In 2001 I purchased a new build home from bovis which included them buying my house of the time as part of the deal. Their sales person informed me that the contract needed to be completed in 6 weeks for this deal to go ahead or the property I was purchasing would be offered to someone else.
The rep advised me to use the on site 'approved independent mortgage advisor' to ensure the contract completion within the 6 weeks, this I did. The on site advisor said that 'they were dealing with alliance and leicester' and that i had to take out additional ppi policies to secure the mortgage, the mortgage advisor dealt with all this as part of the application. both the bovis rep and the mortgage advisor said that i had to complete the contract this way to secure the deal within the 6 weeks. I cant remember if the PPI was through A&L. I have the original paperwork for the PPI but not the mortgage. I have the original letter from bovis confriming the sale and saying that they 'have pased my details to their approved independent mortgage advisor as agreed'. I believe that I was mis sold this PPI .. but who do I claim from and what is my first step?

    That may, or may not, be true but without evidence to corroborate it a complaint will be rejected.

    You complain to the seller (i.e. the mortgage adviser or his employer at the time).

    However, if you cannot prove your allegation you are sunk.

    It is also worth bearing in mind that the Mortgage Code Compliance Board advocated getting a disclaimer from any borrower refusing PPI at the time. This is because failing to maintain repayments on a mortgage could result in losing your home.

    So I think your chances of a successful complaint are slim.

    This is key as you are 4 years prior to regulation.

    A lot of these on-site advisers or estate agent advisers require the purchase of insurances to be done through them to get the free mortgage advice (which is allowed). Are you sure you were told this? What evidence do you have to back up your allegation?

    Your complaint reason is very weak. It is a verbal allegation without evidence some 11 years after the event. If the adviser did require you to buy insurance to get the free mortgage advice then you have no grounds for complaint there. If they did tell you needed it financially then that is not grounds for complaint. If they told you that you needed it to secure the mortgage when you didnt then that is wrong but its unprovable and an easy rejection.

    Your biggest issue is that you are 2001 and insurance regulation didnt start until 2005. So, the mortgage adviser, if they are still trading, can reject it as pre-regulation.
