my selling nightmare

here is how the story goes, blog to follow :

3rd of May : buyer applies for mortgage
25th of May : buyer takes update from adviser , who contacts the lender, mortgage application being processed
13th of June : survey instructed on my house -yay !
19th June : buyer has not heard of survey results.
25th of June : buyer finds out additional documentation has been lost.
04th of July : buyer finds out that additional documents have been found and reunited with the rest of the application.
09th of July : mortgage application too old, more updated documents are requested from buyer by financial adviser.
13th of july : mortgage offer made.
15th of July : mortgage offer arrives to buyer but not solicitor
20th of July : mortgage offer arrives at solicitor
25th of July : solicitor expresses concerns over mortgage offer-unclear wording.
27th of July : buyer visits solicitor to explain the mortgage offer ( involving a gift of equity
27th of July -16th of August : waiting for decision from lender round 2
16th of August : lender confirms happy to proceed with mortgage offer
16th of august : declaration of trust lost
20th of august : I sign transfer deed for buyer
7th of September : declaration of trust found
10th of September : buyer's solicitor request funding from buyer's lender
12th of September : receive completion date for 21st of September
17th of September : buyer's lender changes mond and does not want to complete on mortgage-sale falls through
18th of September : buyer's adviser gets in touch with lender who misunderstood the gift of equity and are now reviewing decision : to lend or not to lend
18th of September : sale back on or sale and purchase collapse
19th of September : what now..........

I won't name anyone.... I have not named the lender

    Sorry to hear this long process. Hope it rectifies, but if it was me I would put back on market as this buyer seems like a headache. 6 weeks to do a survey is a long time! I had mine done within 2 weeks.

    Generally with lengthy delays part of the issue is the client not properly chasing things up. Sometimes you need to make a lot of calls, other times sit in branch/ office until issues are resolved, other times run around with documents yourself.

  • Thanks both for your reply. It is a bit more complicated because the buyer is m yex, I left the house, but it is mine. He wants it so not easy to put on the market not living in it... not even having any keys.
    My solicitor tells me he was not given the completion date, it is the ex who texted me it, so I am not sure what has happened and where the truth now lies. My solicitor is getting in touch with his, but by the looks of it, ..... it is very complex....

    Why on earth don't you have any keys to your own house? Is your ex buying the whole house from you or half? Why are you dealing with such an important issue by text message?? It's only complicated if you let it be, behave like a professional seller not a pushover. Get some keys to YOUR house and turn up there or start proceedings to get him out.

    Text message : they come from him, I am polite and reply.
    keys : my mistake and I handed them over to him last summer because he needed to hand them over for neighbours to feed animals.
    I have regular contact with my solicitor and today told the buyer I would not be willing to communicate with them and that all would come through solicitors.
    Professional l seller : nice concept, indeed, not easy when dealing with such a complex situation.

    get your keys back : ok, easier said than done if I am going to behave like a professional seller.( the only way at the moment would be to go and break into my own house as I have asked for the keys back and still do not have them )

    Legal / courts proceedings : I know, finances ????
