I work for a company, where i have been for 13 years, my employers accused me of setting up a rival company because i put a page on facebook for market research reasons, to see if it was worth starting up on my own, my boss then pretended to be a customer by setting up a fake email address and basically setting me up, the same person who made the complaint also held the investigatory meeting and the disciplinary hearing, where they asked me to hand in my notice, which i refused point blank, should i have resigned or do i have grounds to take them to court for not following correct procedures.

When you say 'the same person who made the complaint' do you mean your boss, who found you out? Or someone else?
If your boss found you out it is within his rights to also chair the meeting; if you are dismissed and appeal, then the person who investigates the appeal will be your bosses boss [or higher]. Also, if it is found that the result would have been the same no matter who chaired the meeting, I can't see you winning if you went to a tribunal. Mainly because setting up a rival page on facebook can indeed be seen as gross misconduct.If you haven't got it - please don't flaunt it. TIA.0 -
He is a sales director, he suspended me verbally on the Wednesday morning, i received a letter on Thursday telling me to attend the investigatory meeting on Friday, i then received a letter on Saturday afternoon, to attend hearing on Tuesday afternoon. I have read on the web that it should be an impartial chairman.0

He isn't the boss, he is the sales director, just the 2 of them run the company. although he thinks he is the boss.0

There is the owner who is managing director and the sales director, the MD was taking notes at both meetings.0

The owner is manager, but the sales director likes to think he is.0
