Hello friends,
Further to a recent post I submitted about a fault with a 14 month old laptop, I wanted to let you know the outcome of the situation.
Well after 3 visits to 3 separate stores, lots of calls to the clowns at head office and eventually letting the trading standards guys step in, we got the laptop repaired for free and were reimbursed the £35.00 I had to shell out for an independent inspection and report.
I'll admit that it was a huge hassle and was quite stressful at times - but if you fight your way past their b***t and pester the life out of them, then you will get a result at end of day.
We were fobbed off at every turn by staff who were deliberately trying to fob us off and at other times, just palmed off with idiotic advice from absolutely clueless oxygen thieves.:mad:
The last straw was when pc world asked us to provide an independent inspection and report which I duly provided. The report stated exactly the same fault that I knew in the first place. Then they refused to accept the report because it wasn't from a VAT registered company - they wouldn't acknowledge that a sole trader isn't any less qualified to repair computers than a VAT one.
In step the trading standards boys to the local store like two mobbed up wiseguys and the next thing you know, the report is acceptable and they want to collect and repair the thing within the next 2-3 days.
It was actually a week before it came back, with the faulty hard drive returned also which was a surprising touch. I don't know about most of you but whenever I get a repair done (esp car repairs) I provide my own parts and usually ask for the old ones back. I didn't do that with laptop so it was good to find the knackered one included.
So my money saving expert chums, remember you have up to 6 years in England and 5 in Scotland to return a faulty item under the sale of goods act.
Having said that you're going to have a bit of a battle on your hands returning a toaster after 3 or four years but I suppose it's do-able!!:)

I think OP did post in this section and then squeaky moved it over to the tech boardCould be wrong about which board it was on originally but theres a few of our regulars in the first few posts.

It sounds that the "Independent Report" just stated what the fault was and not that it was inherent.
If it was indeed a faulty Hard Drive that was the cause, no respectable tech would put his name to paper stating that the fault was inheriant at purchase (especially if it was working fine for 14 months) unless the exact model of HDD had issues where the manufacturer had issued a FW update/recall/extension.
It sounds that the cost of replacing the HDD (£40ish) and accepting a non-complience report costs less time and hassle than arguing, and PcWorld/Currys did more than the SoGA states.0 -

Not sure what your talking about, maybe you should've read original post. There was no inherent problem from date of purchase or since. The laptop stopped working suddenly at about a year old - and was left in that state until I took charge of it at 14 months that's it!!
The independent report didn't just state that the hdd was faulty, it was tested in 3 separate machines to determine that as well as another couple of tests. For the purpose of my follow up post, I didn't include specifics of the report as they weren't relevant. Don't take everything so literally my friend.
Finally they did not 'do more' than the sale of goods act stipulates.
By law they are obliged to either repair the item in question, offer a like for like replacement or to reimburse the customer less the period of time that the item was operational and in the customers possession, so reimbursement of a £1000 television from new minus the 18 months of useage before the item developed a fault. This allows for reasonable wear and tear to be factored in.
So my friend based on the above, PC World actually only came through on the least expensive option of the three outcomes. I can assure you that they did not fork out for a hard drive, inspection report, an hour or so of their tech team's labour just to avoid the hassle and ensuing arguments with a customer.
Did you read any of the post?? I said it was a nightmare dealing with them. Do you work for PC World??
I'm going to stop posting on these forums from now on. You always get some smart-!!!! picking holes in your post, disagreeing with what you've said just for the sake of it. Some trumped up know it all who thinks they know consumer rights better than everyone else.

You appear to be the one who doesn't understand what they are talking about.
Even if the HDD was working perfectly from the day of purchase until 14 months later, the SOGA states that the retailer is only liable for faults if they can be proven to be inherrent.
Just because something fails after a year (or even longer) doesn't mean that the problems wasn't down to a manufacturing defect or faulty materials.
Once you've re-read and actually understood the SOGA, will you be man enough to come back and apologise to "The prat above"?0 -

Yes that's right, I'm only interested in my bersion of the SoGa. That's why PC world fixed the computer, because they realised it was my version that I was trying to enforce and not the version that applies across the board to both retailers and consumers up and down the country.
You don't need ro correct me on anything. I got my device fixed, free of charge and was reimbursed for costs that I forked out, so again, I don't need you to correct anything you arrogant git.
Maybe it's you who should stop posting. You're no help to anybody with that attitude my friend. Regardless of whether I do or don't post in the future, you're definitely missing something mate. Now do yourself a favour!!0 -

I read and utilised the section that was relevant to my circumstancesand and exercised my consumer rights accordingly.
