Tax Credit Expert needed - Child or Adult?

I need a tax credit expert for this one I think. Any help is hugely appreciated.

At the moment my parents claim Child Tax Credit with the Disability element for me - as I'm 19 and still in Full Time Further Education (under the 2006 rules for Child Benefit).

But when I put my details into the calculators it says that I'm entitled to Working Tax Credit in my own right. Surely this can't be right and it's one or the other?

And if so, which one should we/I be claiming?

Also, from October I'll be on a HE course and can only work part-time alongside this, due to my disability, so will I be able to claim WTC then? Or would I have to give up my part-time job and get IB? (Something I really don't want to do, but I have an awful feeling I'm going to get stuck in a catch-22).

Do you currently work? AFAIK you can only claim WTC if you over 25 unless you have children yourself. I also think you have to work 30 hours or more. There may be seperate rules for anyone with a disability.

    Hi Gemmzie,

So from October your parents will no longer get Child Benefit or Child Tax Credit - is that correct?

To qualify for WTC disability element you need to meet the following criteria:

Must be at least 16 years old and work at least 16 hours per week and

have a physical or mental disability that puts you at a disadvantage in getting a job and you were previously in receipt of some form of disability benefit.

There are a number of criteria for the above but without knowing your illness I would hate to hazard a guess at it.

Will you still be classed as a student from October or not?

I've seen the criteria, and meet at least three, often five points

Will you still be classed as a student from October or not?Yes, I think so, I will be doing an HE course - a HND

You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)
