Undischarged bankrupt, O2 contract upgrade

Hi,
I was made bankrupt in Jan this year and had, and still do have a monthly phone contract with O2.

From what I've understood, O2 don't like bankrupts and will usually terminate your contract as soon as they are made aware?!

However, I seem to have slipped through the net. They were not a creditor and I have always paid my phone bill on time.

So, now my existing contract is coming to an end and I have been given the chance to upgrade the handset (nothing to pay and keeping the same monthly payments).

My question is, is it safe to do it? or will me renewing my contract alert them to my presence so to speak? Or am i being paranoid?

Cheers! I eagerly await helpful reply's and people getting stroppy because they think I shouldnt have a phone while bankrupt etc ;)

Hi there Watcher! And well done for getting through your bankruptcy. ( LOL at the bolded bit of your post by the way!) :rotfl:

OK: if you have never been in debt to your phone provider, then there is no reason why your contract should not continue. You haven't lied or cheated or written off any debt with them (I presume )

We have a phone contract with a certain provider and have had since May 2009 and it has continued throughout. We had NO debt with them and like you, have always paid the bill. We have done nothing wrong and you would be doing nothing wrong either.. It's just another bill, like our utilities and rent. So there is no reason why you should not just continue it. :) Best wishes. xxx
  • Cheers Lou67,

However, I will be doing an upgrade with a new tariff etc

Again, from what I understand they don't do credit checks on existing customers, they just look at how your account has been managed thus far so I should be fine in that regard.

I'm just worried that doing it will draw attantion to the fact that i'm still "on their books" so to speak when I'm a dirty bankrupt :o

And regarding the bit you've highlighted in bold, it is true though isnt it? It always happens, on every thread I start, a stuck up know it all will pop up declaring i cant have a car, food, bed or clothing while being a bankrupt :(

Which is a shame as the vast majority on here are so kind and give their time responding to questions to help others etc. And I really couldn't have got through my BR without them :)

I have been on a DMP for the last 7 years and have upgraded my phone with Orange 4 times during this time, with no problems at all.

Unless they actually ask you if your bankrupt, your not lying.

You have paid the bills and so they are happy with you !.

I know you don't really want to here this but do you really need a mobile? kids in my day made do with two cans and a piece of string...sorry just kidding.

Just go for it, if they refuse you at least then you will know. There are other ways around it, I was with O2, couldn't use my own name, but used a family members and my direct debit details...yeah I know weird but even when I ring all I have to do is give the persons name and their pass word and they are happy to talk to me about the contract, even tho our sexes are different.

BTW if it's the iphone 5 you're going for I'm jealous.

LOL! This is so true. Some people really do think you should be living in a ditch, and on crumbs from the neighbour's toaster, and water from the rain puddles if you have gone bankrupt! :rotfl:

That aside, I really genuinely believe that your issue isn't a problem (as a few of the posters here have said.) We have changed tariffs with our energy provider AND had a new deal with our internet provider (warmth, light AND internet as a bankrupt; what am I like? Send me to hell now!) :T But because we were an existing customer, they did no credit check, and they didn't *ask* if we were bankrupt. So as someone has said, if they don't ask, you don't need to say anything. As I said, it's just another bill/outgoing. You're not lying about anything or defrauding anyone. :)
  • Without thinking and only 4 months in... I upgraded to a two year £30/mth deal: accepted without question.

Some months afterwards it stuck me, had I entered into a credit agreement for more than £500?
  • I got an Iphone 4 from O2 3 months after going BR, no problems at all. If your already on a contract and pay your bill on time then they wont search you.

Good point mouse, but would this not apply to car insurance and the tv licence and your water rates bill and so on? Is it really a credit agreement? I am not sure....

I know you have to declare your bankruptcy usually, (if you have credit,) but isn't it only if it's more than £500. I think the OP will be fine on this occasion, but if in doubt, they could ask the C.A.B. But I think it's OK. :)
