I have been in receipt of Incapacity Benefit which is included in my Income support since I was signed off work with severe depression in 2002, 2003 diagnosed with Bipolar and Borderline Personality Disorder, Anxiety, Panic Attacks etc etc.
I received a letter from the DWP stating they were going to ring me within 2 weeks to chat about woteva, I wrote back stating I dont have phone because I cannot stand the ringing, but here is my e-mail address. Before I had change to post it, I received the form ESA50, so I started to fill it in, I then got a letter stating they urgently needed my form returning, this was about 15 days before it was due back, I took it along to Dial House (like CAB but for disabled) to be checked, I then became ill and didnt complete it and send it off, now I am 3 weeks late sending and the other day I received a date for my assessment.
I am also in receipt of DLA High rate care and low rate m obility, I have a disabled son also, should I be put through all this crap?
Can sum1 pls help me.
Many thanx

Send it off with a letter explaining briefly the reason.
In principle, they may decode not to call you for an assessment.
If you do not go to the assessment, your ESA will stop, leaving only DLA.0 -
The labour force is everyone between the ages 16 and 65 years at the moment. All individuals of working age in receipt of IB and other 'out of work' benefits are being migrated to [ESA] other benefits. The two things you need to know right now are :
- you are one of millions, do what rogerblack says, and do it ASP
- you [everyone] has the legal right to have [delayed] all communications by snail mail
- you must complete & return all documents by the date they give you
- not returning the docs, or not returning them on time may lead to an instant STOP on your OoWB
- not attending an 'interview' [WCA] may lead to an instant STOP on your OoWB
NOTE1:
- OoWB means Out of Work Benefits
- ESA means Employment Support Allowance
- WCA means Work Capability Assessment
NOTE2:
- your son's DLA is nothing to do with what's happening to you
- your own HRC & LRM is nothing directly to do with what's happening to you
- snail mail, not telephone introduces a beneficial delay in your favour it gives more essential time to gather evidenceDisclaimer : Everything I write on this forum is my opinion. I try to be an even-handed poster and accept that you at times may not agree with these opinions or how I choose to express them, this is not my problem. Don't think there is much help to be offered.
There are rules concerning eligibility and proof surrounding the payment of benefits and we all have to abide by them if we want the money.
Perhaps a social worker could help you sort things out. Does either you or your son have social worker input?0 -
Send a copy of your ESA50 to ATOS as already advised, I would also send a copy to the DWP office dealing with your claim, marked for the attention of the Decision Maker.
You should also take a copy to the assessment, and ask the ATOS HCP to read it before they start the interview.0
