3rd Party Car Insurance Claim

I was hit by another driver, he accepted the liability but said he didn't have his insurance details with him.

I then contacted him and he refused to give me them so I got the police involved. They got the details for me.

My insurance company are refusing to get involved as I am only 3rd party and the insurance company of the person who hit me say that only the policy holder can make a claim. What do I do?

    Did you take out the legal insurance option?

    If so then canll them.
    If you didn't then I'm afraid you haven't paid for any cover for this eventuallity so you will have to do it yourself.

    I would get estimates and then write to him by recorded delivery (65p).
    Keep it factual but ask for it to be settle in 14 days after which time you will refer the matter to the county court.

    Do you have any independent witnesess?

    The other drivers insurers are being a bit simplistic.

    You can make the claim against his policy and they must initiate a claim record. They can refuse to make a payment from the policy until they have the details in from their policyholder and his agreement to let them deal with your claim.

    There is nothing to stop them investigating the matter though, contacting their guy and asking about the accident and also asking you to get quotes etc. They will just simply qualify their actions with a "without prejudice" heading at this early stage.

    Lisyloo is right about the legal expenses insurance. There are some "post accident" covers available from firms like Helphire but the costs are higher.

    If you have not got any legal cover, go into any garage or solicitors and they will refer you to an Accident Management Co to handle the claim for you. Some ins co's are !!!!!!s for not co-operating if their policy holder is at fault

    Make sure you know whether there are any charges for their services.

    I'm not saying there will be but you should always check.
