Section 75 question

I'm in the middle of arranging to have an upright piano moved from an elderly relatives house to my house. At the moment I don't have insurance on the transit quote because I have absolutely no idea what the piano is worth - been in the family for donkeys years. And I can't get any more info on the piano to estimate the value as the relative is in a home and the next of kin is not really wanting to talk to me.
So if there is a problem in transit, if I pay by credit card and the piano is damaged, does section 75 cover me for anything (the quote is for £108), or will they say tough, you should have taken out the insurance?
There's no relevant cover on my household insurance.

    It will cover you for exactly the same details as the courier, normally removal companies liability is limited within the contract (unless you buy their 'insurance' which extends the liability), as such you'd be covered to the same level of liability via Section 75
  • Yes, good answer.

    The only comment I would add is that sometimes sweeping exclusion clauses in T+Cs are legally ineffective because of UCTA1977 and other consumer protection law.

    The principle remains - S75 only gives you extra protection in the sense you can go after the CC as well as the merchant. It doesn't extend the amount or extent of liability if things go wrong.
