ex on iva and joint mortigage which im currently selling

Hi

i have been seperated from my partner for 3 years and have paid the mortgage soley for those 3 years. prior to that we paid joint for 6 years.
He went onto an iva 3 years ago and is about to either fail or have it extended due to a change in his circumstances.
i was in the process of selling the house but was only making 5500. the value was higher and we should have made 12k.

how will his iva company take his share into account? will they want all of the money i make? what happens as i was intending to use the money as a deposit on a rented property for me and his 2 young children.

thanks

  • If the property was included in the IVA you may find they want half the equity.

Ask him to look at his IVA proposal to see if the property was included - does the property have a restriction registered against it by the Insolvency Practitioner?
