Car insurance question

I had an accident in June 2011 in which fault was being disputed even though the other car ran into me on purpose.
When it came time for my insurance to be renewed the company I was with quoted me £2500 so I had to change insurer.
I have had an email today form claims company handling the claim stating -
[FONT=&quot]Please note that Auto Accident Claims Ltd has been appointed by KGM Motor Insurance to handle the above claim.[/FONT]
[FONT=&quot]I have reviewed your claim and we have not heard anything for over a year from the third party solicitors, due to this I have agreed to close your claim and allow your NCD’s. However if we received any correspondance in from the other party’s solicitors, then we will re open the claim and your NCD’s will be disallowed straight away.[/FONT]


Does this mean the accident has been classed as not my fault?
I have emailed back asking for clarification but they are closed now.
My current insurer said they will refund some of my premium If its found not my fault but the email received today sounds very vague.


The other parties solicitor said they were sending for the police report back in July 2011 and haven't been back in touch since so I am hoping the report was in my favour.

    They wont reply so we will assume its not your fault but can later change our mind if we want.

    Did you claim from your Insurers who I guess are KGM for the repairs to your own car.
  • I was only insured third party as it was an old car and damage was minor so I didn't bother with repairs.
    The other driver and passenger both tried to claim whiplash and their car (which was a brand new moterbility car not registered to the driver but I assume he was a named driver) had damage to the body work.

    I now have a newer car and fully comp insurance which cost me over £800 but old insurer quoted over £2000 so I had to change.

    It would have been nice to get a partial refund but what I'm more bothered about is when I renew my policy next April do put the accident was my fault or not?

    Is there a time limit for the other party getting back in touch?

    They wouldn't even pay for a police report forgot, said they would wait and see it when the other party got it but the other parties insurer never got back in touch.

    Was the driver actually insured to drive?

    3rd party you need to do the chasing and maybe even issue a claim through the courts.

    Nothing in it for your insurance, So they are not really interested.

    You can say it was a "no fault" incident. This means your insurer did not have to pay out anything, and your NCD is unaffected following the incident. (Unless they do come back again!)

    The time limit is 3 years to start a claim for injury and 6 years for damage.

    Tell your current insurer that your NCD has been reinstated and you should get a premium adjustment (and refund of any extra you have been paying since taking out the policy). Also inform your current insurer the incident is now a "none fault" one.
