mortgage co say charges are not illegal yet!

Our old mortgage co charged us £50 per month for 20 months for arrears. We have complained through the ombudsman. My oh spoke to mortgage co yesterday and they are offering us £65 back out of the £1000! :rotfl:
We were also charged £190 mortgage exit fee and they are offering us £50 of this back. Does anyone know if they have to offer the full amount of the exit fee back?

    If you honoured your commitments and paid on time you wouldnt have had arrears and would have avoided the charges. There is a very simple way of avoiding these problems. If you put one extra months expenditure in your current account, it doesnt matter if we have an error like the recent BACS transfer problems and pay doesnt go in on time, there is still money to pay the bills

    You dont know the story, and i didnt ask anyones opinion on paying bills on time either. My question was regarding the mortgage exit fee.
  • Sonia you complained about your mortgage company charging you £50 for arrears, therefore you yourself made an issue out of it.

    If you don't pay on time, it is your own fault.

    Its true, mortgage companies have every right to charge for arrears, you are costing them money in manpower to recover and interest that would be otherwise earned on your payments. I can't believe you have actually got the face to try and claim this back. Thats the problem these days people like you expect to get everything for free and then can't take the truth when it slaps you in the face.

    There wouldnt be much point in charging an exit fee if they had to give it back would there?

    Refer to Martins article on exit fees ,he has a standard letter which you can send ,just insert your details.The fee should be in proportion to the work that they carried out to complete it.
    I am sure that £190 is excessive Good luck.
    The arrears have nothing to do with the exit fee .

  • I can tell you with absolute certainty that a mortgage arrears charge of £50 per month will not come anywhere near to covering the actual cost of managing your account during that 20 month period. I really hope the bank actually make an effort to defend this type of action which is just another case of trying to get something for nothing as mentioned by MortgageMamma.
