Reject a faulty second-hand car?

I bought a car, 3 weeks and ~1000 miles later the engine expired with horrible grating noises. Garage I bought it from have had car 9 days and still cannot tell me what has gone wrong or when it will be fixed. Car was 4 yrs old and 150 000 miles (full Audi service, looked and drove like new)

I suspect they are doing a cheap repair or getting a replacement engine second hand but I would rather have my money back. But, to do that the onus is on me to prove the fault was pre-existing when I bought it.

Q)How detailed does the 'independent report' have to be in order to reject the car and sue the garage for my money and expenses? :money:

Because if it is the case of a technician listening to it and giving an opinion, that is ok and will cost 100 quid???, but if it needs a strip down etc that would be v v expensive and I cannot afford it.

I don;t trust the garage or the car, is there any way of getting my money back?? Garage owner is rude and unhelpful so far, he says I just have to be patient and not 'hassle him' - unbelievable!

    What do you mean by 'cheap repair'?

    They are entitled to repair or exchange the vehicle. In this case you suspect the engine may be exchanged - it would need to be on a like for like (or better) basis.. it's highly unlikely to be the case.

    Was this an ex-fleet car by any chance? I certainly wouldn't buy a car that one of my lot has driven for 3 years, even if they are kept in an immaculate condition.

    If it was the 1.9 TDi, it could well be a turbo problem, which will be a £1200 job (says he who caused some serious damage to one of our Octavias, 2 days before it was due to go in for repair). I can't remember the exact amount, but I know it came to something like this.

    Apart from that, the engines last forever, so you should have 200k+ of trouble free motoring from it after it's done.

    Apologies for starting new thread, I thought everyone had left the old one and moved on... :o

    Anyway, by "cheap repair" I mean in a garage of questionable quality using parts of the same iffy nature. And the reason I suspect this is that the garage will not tell me where my car is being fixed or any details what so ever.

    If, say, they put in a replacement engine of equivalent quality that still means that I will have no idea how that engine had been looked after and when I sell the car the new buyer may be aware that it has been changed, and therefore the car is worth less, qed I will not have been put back in the position I was before the engine blowup.

    I am concerned as the garage have ignored ALL my emails and calls and one letter (so far), so I am nervous about my 8 k investment, and all I have asked is *what is wrong with it, *roughly when will I have transport back, *where is it being fixed.

    As for all the talk about 'ooooh I wouldn't have bought that' :cool:. Well, annoyingly, I agree, I won't do it again, but it doesn't change the fact I still have rights (although u have to pay solicitor to enforce them sadly)

    The law says I should be put back in the position I was in previously, or something like that. I am worried I will not be and the car will be a) unreliable due to cheap repairs, and b) worth less
