  • Just waiting for the OP to return with the details. I mean, if this is a true case of Byelaw 14 then it is. Not the end of the world, there won't be any private company making illegal bucks and we can then concentrate on an effective appeal.

    Yes but as I said above, as far as I know the bylaw does not extend to 'parking within bay lines', only the purchase of a ticket. So I assume the Penalty says something vague like ''Contrary to Railway Byelaw 14 or terms and conditions".

    Therefore it's only an alleged breach of conditions = cannot be pursued under bylaws and won't go anywhere if the car park sign doesn't even state those conditions...

  • Also, the OP reveals possible confusion in his wording.
    His reference to "Parking Charge Notice" is very revealing. But then he immediately cites the word "fine" which we know will not feature on the document, Byelaw 14 or not.

    I asked for photo for my first ticket they emailed it to me lucky I discovered mse before I paid. Lol the excuses they make
    The word about the scammers is spreading like marmite here in the westcountry.

  • Just to highlight post I submitted on another forum concerning Railway Bylaw 14 car park penalty charges.

    In my experience most train stations are issuing Railway Bylaw 14 penalty notices unlawfully and in direct contravention of the Statute as their car parks are not displaying the correct visible warning signs with penalty amounts clearly marked..

    Railway Bylaw 24 para 4 states:

    (4) Notices
    No person shall be subject to any penalty for breach of any of the Byelaws by disobeying a notice unless it is proved to the satisfaction of the Court before whom the complaint is laid that the notice referred to in the particular Byelaw was displayed.

    Bylaw 14 (4)(I) is clear in that the penalty amount must be displayed.

    In short, unless the Station Car park is clearly sign-posted stating people will get fined a specified amount then no penalty can be claimed.

    If the notice has been issued unlawfully anyone can claim back their Railway Bylaw 14 parking fines, for the last 6 years, by filing a N1 claim form at their local county court. The court cost would be £25 claim issue fee plus a £25 hearing fee. Court costs would be refunded on a successful claim.

    Even if the car parks do install the correct signs, there is still the 'contract with no consideration' and 'penalty charges applied in terroreum' hurdles for them to jump.
    If a number of people get together then a class action can be organised using one set of court fees. There is no limit for the amount of people in a class action claim.
