DD...first accident...likely outcome...?

Scenario:

DD driving along in normal fashion in left hand lane

Car in right lane "drifts" over white lane into left hand lane

Strikes rear/side panel of car (just behind rear wheel)

slight scoring damage to DDs car ( brand new 2012)

he reckons his car wasn't damaged (he popped his front left bumper trim back into place) and says you wouldn't notice, he says there's quite a few bumps and scores on his car

other driver admits he drifted over line and was his fault he hit her
(daughter actually asked would he mind if she video recorded that statement on her mobile phone, he agreed)

Ins details exchanged, police report number obtained....

What is the likely scenario in this case...

will her premiums go up?
will ins companies go for 50/50 as I've read a lot on MSE?

any info greatfully accepted...

    he will be held liable, but dd will need to declare none fault accident for 5 years, some load others dont
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • Assuming he sticks to his story of drifting then it would be fault on his behalf.

    If he changes his story to claim your daughter is the one that drifted then 50/50 is a possible outcome if there were no independent witnesses to the incident.

    Problem with anything said at the scene of the incident is shock, claiming that you made to say/ sign something under duress etc etc

    Fortunately Daddy was in the car with her as a witness but because it was her car, her insurance, he allowed her to deal with it.

  • "Daddy" by definition isnt independent and could in fact be alleged to be the one threatening the TP to make "the confession"

    Obviously hopefully it will all go smoothly and in reality the majority of claims do, its just when things go smoothly they dont make for very interesting discussions on forums which is why you only read about disputed liability cases.
