Bank Charges Small Claims fee

Hi. In 2007 I paid £120 to HMCS to launch a claim against my bank, for unfair bank charges. I later got a letter saying that all claims had been suspended pending the outcome of the test case. As we all know suprisingly, the courts ruled in the banks favour.

As my case was never heard, can i reclaim my £120 or is that money now lost?

Who do you think should refund you for your filing of your unfounded claim against your bank?

The risks of taking legal action and losing are that you can suffer the costs.

  • It didn't actually get to court, i had no court date and it wasn't thrown out, that's why i asked the question.

The fee was to file your claim with the court. Your claim was successfully filed as the defendant responded.
