That's incorrect, and hasn't been the case for nearly 3 years now. :)

While once you tell the bank to stop the payment. It can be claimed back after it has debited. Do you think that banks contact every co to say that X customer has cancelled with them..... Banks are unable to block a individual co's from taking money from a customer accounts.

Far easier to cancel with the co concerned. As they are the party that takes the money.

FYI. So long as you have told the co to stop taking the payments. You have been able to claim the money back after that date via a Visa chargeback.
Something that I have done for many customers over many more years. Before even PSD was implemented.
Now we have to advise customers that we can take their stop on the payments. Something we have done since we got word from legal about the new regulation. But cannot block the co from taking the money. We advise how it is resolved if they take any further funds.

Time that the FSA/FOS, instead of targeting the banks. Took the co's that fail to act on a instruction to task.
It would have also helped if VISA/MASTERCARD had been involved. As this is a breech of their T/C that ALL parties signed into.
If Visa/mastercard wanted to they could take this forward to the EU courts. In effect the EU have ruled that any T/C are worthless.

can you verify that these charges can be returned back to her account so the matter can be once again between her and the payday lender? She hasnt been able to pay the payday lender back because she is now in hardship, and the account is dormant, but she doesnt want to be owing Natwest the money, especially when the payday lender was informed of the circumstances and had agreed not to take the money, .

The crux of the matter will be the date she told payday lender, against the date they took the money.
If it was before payments were taken then they could be returned as a cancelled CPA.

Although all this will do is rack up more charges/interest.

Perhaps it would be better for your friend to talk to CCCS.

  • So much brilliant information, thanks to all posting.

Natwest told her that they cant reverse the payments, so is this not true? what does she need to state to get them reversed? They show as POS transactions on her statement. To add insult to injury, she actually called Natwest after speaking to the lender as the card was lost, so it shouldnt even be active for anyone to have taken payments from. As for owing the money, she is in the process of getting a Debt relief order, something the payday lender was made aware of, so thats being sorted.

Your friend would just be better off speaking to the correct department direct 0845 366 0391 and not going via telephone banking.

They wont be able to cancel transactions already taken place however the bank will possibly refund them then ask the payday lender to reimburse them.

Who she called? I bet they probably won't refund if a payday lender is involved. Possibly as far as the bank is concerned either way the money is owed.

And your friend did not know all these things two or three weeks ago, when she took out that Payday Loan?

There are so many people out there, who believe they can s***w the Payday lender, only to get s***wed by them.

Payday lenders are ruthless; well, they have to be with their kind of clientèle.

  • The payday loan was took out in april, the payments were taken in july, over month after she had called the payday lender to advise of difficulties and try and come to a resolution. Not sure where you got that this had happened weeks ago?
