are car repair guarantees transferable to a new owner

I bought a used Ford Ka in July but after owning it for 3 weeks noticed that it was leaking power steering fluid which gradually got worse. When I looked though the service history I noticed that it had a new steering rack fitted in April which cost £395.00. I contacted the mechanic that did it and he said his contract was with the previous owner and refused to deal with the problem. I had to have the steering rack replaced with another mechanic. Does anyone know if this mechanic is right in that a guarantee does not transfer to a new owner. Thanks for any help

    Check the guarantee's ts and cs and take it from there.
  • There are no t & c's on the invoice but I assume his work must be covered for 12 months. I just need to know if I would be covered as a new owner. Thanks.

    you don't have a repair guarantee
    The warranty related to the original owner who paid for the work
    The part may still carry a guarantee from the supplier,however you would have to pay the mechanic labour for removal/refit

    more than likely not transferable and that is if he even offered a guarantee in the first place
  • Have you had it properly diagnosed? Maybe its not the rack but a pipe or the pump itself?

    Not unless the terms and conditions state it is. Under SOGA, the contract is between the owner at the time and the person who did the repair. There is no requirement under SOGA to make any guarantee transferrable.

    There is also no legal requirement for his work to be covered for 12 months.
