PCN on single yellow line..appeal??

I parked on a single yellow line, on a Saturday and I was shocked to be issued a PCN under code 27 stating that I was 'parked in a special enforcement area adjacent to a footway, cycle track or verge lowered to meet the level of the carriageway'.

I was taken by surprise because I have always parked in the same place every Saturday since November 2011 and have never been issued a PCN. Although I am aware that there is a very small lowered dip in the road (used for the removal of refuse by the local authority every Monday), I am also aware that the local authority's refuse collection is never carried out on a Saturday because of the market that takes place every Saturday of every week.

Furthermore, where there is the lowered dip in the road there is a small gate which was locked and can only be opened by the borough's refuse collectors, so the dip couldn't have been used by anybody else and I have checked all this information with the local authority.

Should I appeal this ridiculous PCN? If so, on what grounds?

  • The usual advice here is council issued tickets are best taken to pepipoo forums for advice: http://www.pepipoo.com/

    They will want to see photos of the location, lines, signs etc. And also scans of the ticket (which you should remove all identifying information from).

    If you can locate the local authority's documentation on parking restrictions etc. specifically with regards to dropped curbs and obstructing etc. then it would be useful to provide that too.

    Your grounds could be all sorts of stuff including technical points, Pepipoo posters should help you. Also have a look online in a search of summat like 'Code 27 definition of a dropped kerb' and you should find something for starters.
