                    my firend moved into a flat, that her ex owns (he is not living with her) and she and him have a baby.
She has been there 2 weeks and no contract has emerged, but he wrote to the council saying he was letting the flat to her, as she wants to claim part Housing benefit.
Today he has come round and told her to get out, for no reason!
He is in the house now threatening her, and telling her to leave, and if she doesnt he will come back and change the locks.
She is saying he will have to get an eviction notice now, but he is saying tough cos theres no contract, so prove it!!
What can she do?

 she should try and get hold of them now and get some proper advice, failing that ring a solicitor immediately before they close. hth.

            If she has no contract, she has one by default, it can actually work in her favour not to have one. If they lived at the property together at anytime she may have a problem.Well life is harsh, hug me don't reject me.0

            I have both my kids so not fair to take them with me while the police are there, but will go round at 5.30.

            If the Police are still there, she should try and get them to note that he rented the place to her.
 The fact that he has written to the council backs this up.
 Like I said, if no Tenancy agreement exists, the law recognises that she has an Assured Shorthold Tenancy by default.

            Regardless of these events, she won;t get any HB on a property owned by the parent of her child.
 It's a clear exclusion in the HB regs.0

 Domestic violence services are overstretched, so they are unlikely to house someone who hasn't suffered it.Well life is harsh, hug me don't reject me.0
