Going through a red light whilst on a driving lesson

    The superviser's duty is to make up for any deficiencies in the skill of the learner; as part of his/her duty he must participate in the driving to such an extent as could reasonably be expected to prevent danger to other persons or property. Beacause he has a righy of control over the learner driver, a superviser can be convicted as an accomplice to a driving offence committed by the learner driver if he deliberately fails to prevent it when he reasonably have done so.
    The key consideration for the driving intstructor would be 'deliberately', however it is clear that the driver will ultimately be responsible

    I know for speeding then you both get points. As the instructor should have stopped you, but you shouldnt have done it in the first place.
    To be honest not many traffic lights have cameras on, so I wouldnt worry. But if she does get some sort of punishment her and the instructor will probably get it.

    The instructor is responsable for the actions of a learner driver under their care.Your sister needs to change instructor though as if he is allowing this sort of thing to happen he should not be teaching learners, or they will think it is the normal way to behave on the road.
  • Legally the driver is responsible for their driving, so only the driver will be penalised for any driving misdemeanors like this - sorry guys.

    However, I'd be a bit peeved at an instructor who let you get penalised like this and would be expecting them to make it up to you in free lessons.

    The only way the law can penalise the instructor in this situation is to get them on aiding and abetting - however this is almost unheard of.

    Whoever's going to get nicked - or not - sack the instuctor asap. He didn't notice the amber light either !!!

    Hang on a minute - maybe there was a car too close behind so the instructor could not stop her safely.
    Driver is responsible. just because there are dual controls does not mean the instructor has control of the car (after all he has no steering wheel!).
    however the instructor should have been prepared for the change of lights (as should the driver) and made sure the vehicle could stop if it needed to at a red light.
  • i was told when i was learning, that as i was under the instructors control, he would be penalised (only informed of this as he was worried about gettin points for my speeding lol). the instructor shld have stopped the car, and the car behind would have been preparing to stop, so it would have been safe to do so

    Absolutley, and they are carried over to your full license when you pass. In the case of the OP's question, when driving (even with a driving instructor) the driver is responsible, be it speeding, running a red light or heaven forbid, running over a stray child on a dual carriageway.

    Not true, pretty much all red light cameras are digital. It's the normal gatsos (not tru-velo) you don't need to worry too much about.
