Help Getting Money Back

Hi there,

Just recently I booked and parked with a website for parking. If you google "Wembley Stadium Car Park" they come up on the advertisements bit right at the top. Not sure if we can name and shame here or link, but basically they are the ones with the name of an insect that can sting you (how fitting!).

So as you can see they advertise as the Stadium Car Park, which is wrong as they simply are not! They've now put up their location on a map so you can see they are definitely NOT the stadium car park.

Anyway, cut a long story short my car was damaged whilst parked there (I'd already paid £20 by the time I had got there it was too late when I realised). I asked them for their CCTV and insurance details but theres no reply from them. Nadda.

So I go to their terms and conditions page and they say.... NOTHING! Just says "email us". (I just checked and it's still the same).

I informed trading standards and they seem to think I should send a letter demanding my money back etc etc. They feel I am in the right because they state CCTV and insurance on their website as their selling points so if this is not true I should be reimbursed my fee aswell as the damage to the car (or some part of it anyway, eg insurance excess).

So my question is this, I don't think writing to them will get me anywhere (they use an industrial building thats all locked up) but could I possibly get a charge back from my credit card, and maybe hold my credit card liable too (I doubt this at all but thought I;d ask the more knowledge folks on here)?

I mean read the website and you'll see what I mean. Especially the Terms and Conditions. I thought websites had to have one???

  • They could somewhere in there terms have damage etc is left at owners risk etc.

    Websites dont have to have a T&C however if the company states they have one they should provide a copy.

    They probably have public liability insurance.

    How are the negligent in the damage to your car and why should they pay?

    Thanks for the reply. I was ushered into a space where upon my return I think something fell off the wall and hit my car. Also thinking that I was duped into parking somewhere that wasn't quite what it was made out to be.

    Also no terms and conditions at the "car park" (it isn't one! It's just an old industrial building's forecourt!)

    So I guess I've got no real hope of any respite here?

    You parked it in that space not them. So you had a choice of not to park there.

    They didnt cause the damager personally.

    Do they have proper contact details on the website? Name and address?

    You could try a chargeback. But under what grounds? You paid for parking and you got to park.

    You could see no CCTV when you parked so had the choice again.

    Spread the news to your friends not to use them and move on.

    If you do spend maybe months chasing this and taking them to court what are the chances of them paying?

    Dont think you have any grounds to complain that the car park wasnt where you thought it was, you could have checked before booking?

    it was a car park as you parked there.

    As for the damage I guess when you get to see the t and c it will say "at owners risk"

    And I know I should have checked but the link on google (which I know understand is an ADVERT!) said parking at wembley arena
    My emphasis on AT. I just assumed it was AT the arena. Surely that's false advertising then? If nothing else? If you google it now, you'll see the same result still! I'll try to get a screen shot.

    I suspect you're right theres not much point chasing it, BUT there was never any signs or terms and conditions, nothing about damage etc etc.

    I never said they didn't have cctv, I said there not supplying it.

    ah well. live and learn i guess.

    I googled and it doesnt say parking AT it just says wembley event parking and shows the distance on a map.

    As an aside I never click the sponsered links and I usually park in someones drive at events..parkatmyhouse
  • I don't think there is much you can do about the location, the map is on their website and I don't think they're really trying to hide it. The term "at" is pretty ambiguous and distance is relative...

    They have to provide you with ts+cs if you ask for them, so I would send them a stern email asking again and then you'll have a better idea of where you stand... presumably you had to tick a box saying you agreed to the ts+cs when you booked... and if they say they accept no liability for damaged caused within them, it'll be difficult to argue.
