Can I claim for a Failed delivery if I work from home?

Hello, I ordered an item from a well known high street store, to be delivered the next day, it didn't arrive, they refunded the postage charge and told me it would be the next day, again it didn't arrive, and again told me the next day, which it did, last thing inthe evening. It was a high value item, and so it needed to be signed for, and I was told the deliverys were anywhere from 7.30 in the morning until 9.30 at night. So I had to basically stay in he house for those hours, until my partner came home from work. So I lost and extra two days, on the already allotted day off delivery. I work from home part time, have a dog to walk (!) and also pick my mum up from a hospice she goes to everyday, for the three days ,i couldn't do any of it.can I claim for days off work or something for the sheer appalling service, my inconvience and the numerous telephone calls spent chasing it? As I work from ome I'm not sure where I stand.....

    You can always try...

Life's full of inconveniences and not everything can (or should) be 'fixed' by bunging a cash sum at it. If you can genuinely demonstrate that these missed deliveries have cost you money then, by all means, approach the complaints department and ask for reimbursement.

I suspect that you can't really do that. Being unable to walk the dog and pick your mum up doesn't constitute loss of income nor do I understand how you can claim that you've been unable to work when you work from home. I also suspect you'll get nowhere with the company beyond a few vouchers (if anything).

Chasing compo for every one of life's mishaps is pretty distasteful and can get you flamed on here :D

  • You work from home, and you were stuck at home... But couldn't work? Eh? :D

I'm referring to http://www.moneysavingexpert.com/shopping/delivery-rights , as postedby Martin Lewis. Genuine and fair question, followed by presumptuous answers.

I would suggest you read the whole article as I don't believe you fit all the criteria in the 5 things you need to know

    In the very first paragraph..
It's enough to make you growl. You've been told you need to be in for a delivery or service installation - sometimes taking a day off work. Then you wait in all day and they're hours late, or don't turn up

..I don't understand why you had lost a days pay if you work from home anyway..

My point is whether I work from home or not, I waited in for three days for something to arrive, that's was supposed to be next day!
  • Yes, but did you actually lose anything?

If you work from home and were kept at home you have not lost out since it did not stop you from working.

I am not sure what not able to take your dog out for a walk is worth?!

  • Not sure about compo, but have a moan at the "well known high street store". See what they say.

TBH I think that *is* your main point - if they offer next-day delivery and failed to honour that then cancel the deal and go to a store that does deliver when they say.
  • Other people have said it, but in legalese if you do not take reasonable steps to minimise your losses then the court will not appoint any/what you asked for.

For example, you purchased a washing machine, it failed and you had to go to the laundrette across town, but you had the old washing machine in your garage hooked up for your gym stuff.

No way in any court would you get a judge to award you laundrette costs. You have a responsibility to minimise any inconvenience and costs.

Your options are to complain and hope for goodwill, if not cancel and go elsewhere or keep the goods and forget about it.
