ESA appeal. What date is benefit payable from?

If ESA benefit is stopped by DWP and then a person sends in a GL24 for an appeal and decision re-consideration, when is benefit payable from? From the date the GL24 is received or from the date that the ESA was stopped?

DWP have not been entirely clear about this. They sent me one letter about a credit which barely covered the cost of the phone call that I made to check that they received the GL24. No other letters before or since then.

Therefore can anyone tell me when benefit is payable from, in relation to when it was stopped or GL24 received?

  • Your ESA should continue to be paid from the date it was stopped. If you haven't done so already, you should consider getting your local Citizens Advice Bureau to help you with your appeal. You are more likely to win an appeal with them helping you.

  • To get assessment rate ESA while your appealing you will need to send in sick notes from your doctor from the date your benefit stopped.The DWP should advise by letter when this date is.If the date has passed,ask your doctor to backdate your sick note.You don't need to wait for the exact date of your benefit ending,as long as your sick note covers that date.Good idea to get your sick notes dated at least a couple of days before the last one runs out so it overlaps your current one.If you can afford it,send all correspondence to the benefit office dealing with your claim/appeal by recorded delivery and take copies of everything.At the very least,get a proof of posting certificate from the post office when you send anything in,its free to do that.
    I have sent a sick note already and should be long enough to cover until the appeal is heard. I am pretty sure it was my GP's screw up that caused the problem with the evidence in the first place. I should of got my own and not relied upon Atos or DWP to get it. Lesson learned!

    I sent it first class and got a receipt from the post office. I have heard that sending recorded etc can mean it takes longer and can cause problems because it needs a signature.

    Thanks, that was the information that I needed. There are some credits to my bank account but they don't seem correct. It's been over 5 weeks since they stopped my ESA benefit and they have not paid me 5 weeks money. It looks like someone has mistyped the amount for the letter I received and it should of been for 3 weeks money. When my ESA first started they "forgot" to pay me and I had to chase it. I will now have to chase this mistake and that will cost me yet more money.:mad:

    Does the regular fortnightly benefit cover the previous 2 weeks or the next two weeks? I would think it is the previous 2 weeks but I want a confirmation.

    Citizens Advice have been a total waste of time and the two visits that I made, cost me bus fare and they didn't provide any help at all. Short staffed and they closed up 3.5 hours early and on one day and the other I didn't get any help either. All that delayed sending in the appeal with no help whatsoever.

    Thanks but unfortunately there is only an 0845 number which costs a fair bit due to the long waiting times. If only there was a 01/02/03 number it would be considerably cheaper. For my local Benefit delivery service, there are no other numbers available unfortunately. :(

    Does not work for these numbers.
    There isn't a way to call them through other than the 0845s.
    There may be alternative solutions - skype, for example though.

    Has your doctor given you a 12 month sick note? because thats how long a tribunal can take.
    Yes, my GP did give me a 12 month sick note.

    With the long wait, I would of thought that there was only one Benefit deliver service phone number but that saynoto site lists a number of other areas also having Benefit deliver service phone numbers. The few that there are, do have alternative numbers available, it's just a question of whether they work. I might try one tomorrow to see if I can get through, it won't cost me anything so worth a try. ;)

    I don't have skype but I do have a VOIP provider to get around BT Basic's high call charges, but they charge slightly more than BT for 0845.

    roger,i just put 0845 604 3719(without the gaps)its for bolton jobcentre plus amongst others. and its come up with a long list of geographical numbers.Try it.
  • You can call for free from your local Jobcentre Plus office or alternatively email them via the directgov website (just put contact jobcentre plus in the search engine). I email regularly and the response times are pretty quick.

    I thought the government had banned it now, many doctor only allow to provide sick note up to 3 months each visit. But, 12 months is a hell lots! Don't think government won't accept this!

    They have not rejected it and there has been plenty of time for them to do so. The ESA appeal has been processed, accepted and money is being paid at the assessment rate.
