Ppl at work said i quit voluntarily -JSA

hi there,
I was hired directly by a company supposely on a casual basis. There is no written agreement as everything was agreed verbally.
Things didnt turn up well after a month as they've stop calling me back to work although there were work available as they took on a lot of agency workers - this is a warehouse work - picking packing. So its quite a big hint that they wouldnt want me back anymore.
So i have asked for my p45.
Job centre contacted them and they've said i have left voluntarily and now refusing my JSA.
Anyone can comment on this? Do i have a case 'siding' me? I am so sad the com is doing this. The saying love your work and never the company is so true..:(

Well you did quit voluntarily. Mainly because your (verbal) contract was you were to be used as and when they wanted you and they hadn't called you so you had no income.
You need to explain to JCP what the verbal contract was, that you weren't being called to work, had no income and now you realise that you need to find a job with set reliable hours so you have something to live on. Hopefully if you get a reasonable advisor you shouldn't be sanctioned for that.
What have you been living on in the meantime not having worked much on this casual basis?
Unfortunately, you did quit voluntarily though, but given what you say, for good reason imo."Our prime purpose in this life is to help others. And if you can't help them, at least don't hurt them." Dalai Lama0 -
Thanks Pippa for your reply.
I have sent an email to my previous employer to clarify the situation. I havent got any reply nor i think they will.
It just seem a little unfair for them, the previous employer to do this me. It feels like i am getting punished for working. If i havent taken any work, this problem wont occour. It just sound so wrong.

tell your adviser you are happy to work there but are not given any hours, tell them as far as you are concerned if a call came in for work you would be happy to go.
Tell them that asking for the P45 was done because you hadn't been offered any hours in x amount of time so was getting ready to look for new employment.
It's all down to how your adviser is feeling that day, it's sad to say.0 -
What did you do before this job? Were you on JSA? If so, I think there is some way of going back on JSA if the job didn't work out. Please forgive me if my comments seem abrupt or my questions have obvious answers, I have a mental health condition which affects my ability to see things as others might.0

I worked previously..off and on..twice made redundant and never claim JSA before due to the fact my husband is working full time till recently for few weeks and got offered this contractual job for him and casual basis for me. me and my husband were working at the same place, that is how i got this verbal agreement casual basis job
Raksha, are you able to explain further of that 'some way'?
Now that his contract is over, we are trying to get joint claim again.
I am suppose to submit my comment on this to the jobcentre tomorrow and i want to make sure i am saying the 'right' thing.[FONT=arial, helvetica, sans-serif][FONT=arial, helvetica, sans-serif][FONT=arial, helvetica, sans-serif]

I do feel for you, and it's not a nice situation to be going through :-(
But you asked for your P45 and the decision maker will classed this as leaving voluntarily, as you made yourself out of work. Even thou you were contracted on as and when required basic's.
I agree with pippa. It's a good cause to leave a job, because you were not having any income from them.
When you say JSA is refused, are you on a santion! If so you can appeal.
I'm in the same situation as you at the moment i'm on a sanction 6 weeks but iam still signing on, tomorrow infact and i will ask about hardship payments until the sanction is lifted. I can't do anything about it as a decsion has been decided.
Just keep looking for a perment job and dont apply for temp jobs or as and when required jobs, as they can lead you into many problems with benefits.
Keep strong.0 -
OP were you off JSA totally or handing in hour sheets, as you say you were not getting any hours so what were you living on?
If you are on no/low hours you can still claim JSA, so just say you are not saying on because you have left but because you have low/no hour and need to claim untill you are offered some more hours, say you asked for the P45 because you thought you needed it to claim JSA (they do ask for one so that is not a lie)0
