eBay/Paypal help please

I purchased something on eBay but it hasn't arrived. I have asked the seller to chase it up they said they would. After a while I contacted again to see what happened but the email was undelivered so I contacted eBay who said to go through Paypal as that was the payment method used.

Today I got this email from the seller

"I told you I was putting this investigation with the post office, who I assume will contact you.
Why go through to paypal to report me? Your goods werre sent and for all I know, until the post office finish their investigation, were received by you.
You need to be patient. If the post office refund me then I will gladly refund you. You can contact me whenever you like via eBay."


I emailed back stating I had tried to contact them & also that eBay advised going through Paypal & have now had this reply.

"Hi, I don't accept ebay would advise you of that as you know I was dealing with this through the post office, I don't see what more I can do. Your email came through ok tonight, so why not the other day?
I am not happy with this situation as I have done what anyone would expect of me in this situation and have acted in good faith. I am not a dishonest seller, and do object to your implying, through reporting me to ebay, that I am.
I will continue with my claim through the post office, and will refund you in full when I receive the said refund. I would appreciate your withdrawing your complaint through eBay, allowing us to continue sorting out this problem as any other seller would."

I'm not going to cancel my Paypal claim until I get my item or my money back, what should I do now? How do I reply to this? :confused:

    Ideally the seller should refund you and then claim from the Royal mail themselves. It can take weeks for the Royal Mail to pay up.

    I assume that this item wasn't sent via recorded/special delivery?

    I think you've done the right thing by starting a PayPal dispute. The next step would be to escalate it to a claim.

    how long ago did you buy it?

    i would just tell her that since you have not received the goods then you are entitled to your money back and that you will cancel the paypal claim once a refund is received, if no refund is received then you will continue with your paypal claim to get the refund you are entitled to
  • It's already escalated as it claim up on the screen to do so. As far as I know it wasn't send recorded or special as surely the seller would be able to check then that I haven't got it?


    What's narking me more than anything at the moment is seller is making me out to be a liar - or is that just me?

    I would be feeling angry as well to get an email like that from a seller. I am also suspicious of the fact that they want you to withdraw the paypal chargeback, whatever you do leave it in until you get either your goods or your refund.

    If you want to respond to the seller keep it short, just say that you confirm that as soon as you receive either your item or a refund you will of course withdraw your paypal claim and advise paypal and ebay that the matter has been closed. It doesn't specifically answer the sellers concerns, but frankly I wouldn't get into a shouting match with them at this stage.

    yep, and if seller doesn't have online trackable proof of delivery then paypal will decide in the buyers favour

    " I contacted the post office when you first advised me of non delivery, they are looking into it as we speak. They have the original proof of posting, of which I have a copy. These things do take time. As it is obvious you do not trust me I think it best if we do not trade in the future. My feedback does speak for itself as I'm sure does yours?"

    It's not that I don't trust the seller, I just want it resolved.

    How long have you been waiting? You've got a good case for a stroppy reply if it's been a long time. (Not that that would necessarily help, but it might put things in context)
    My TV is broken! :cry:
    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    you may want to politely point out that they as the seller are responsible for either a refund (or replacement, especially if they are a business).
    I would never make a customer wait until I was refunded through the P.O.
