Help! Can't help back my deposits from Foxtons

Dear all,
It's been a week I still haven't got my deposits back from Foxtons since they failed to promise to delivery the flat I was supposed to rent. I asked my agent to give me back my deposits last friday on 31st August, 2012 and she said she passed the instruction to their account team on the same day and the action would take place on 3rd of Sept last monday. In the foxtons business practice, it takes three and five working days to get back my deposit, as she explained this practive to me on the day when I asked my deposit back. Since then, I rang my agent a couple of times regarding to my deposits. She said she has already contacted the foxtons account team and definitely I would get back my money back today. However, no money in my account yet.
Here are my questions:
1.) What can I do in this stage? Foxtons really gets on my nerves. I have been messed around by them in few separate occasions. I have just rung my agent. She said she would look into it and contacted her account team.
2.) Can I take them into the court? I felt so badly treated by them

I would just go and sit in their office (putting other customers off) until they give you the money.0

Ring up and speak to her line manager. Or call their big office in Chiswick Park. Number below

Thank you very much for giving me some precious advice. I went down to their office in Canary Wharf. I didn't see the estate agent but her line manager. When I was in the office, I was loud and noisy. I !!!!ed them off big time by telling their potential customers about what and how I got messed up by Foxtons. They were furious at that time but I didn't give a damn because I just want to a true justice.
I made a huge scene and had a very tetchy conversation with the line manager. At last, I won and the line manager made a quick phone call to the foxtons account time. He told me (without an apology) that their account team didn't get the instruction from that bloody estate agent. He promised me that I would get all my money back next monday because he had already instructed the account team to make the money transfer to my bank account immediately.
After that, I further asked for my original copy of my contract which has the signature of the landlord. They gave me more that the original contract. This includes another document called a preparation of property for tenancy with a signature of the landlord.
Here are my questions:
1.) May be I am being paranoid, would I still have a slim chance not getting my money back next monday?
2.) I am thinking about taking the landlord to the court. However, before I am doing so. Can I send him an email telling him that I am preparing to sue him if he is not willing paying me my financial loss which includes the B&B bills and the moving cost?
3.) is there any sample letter template which I could copy from the Internet?
4.) Would it be possible to ask for a month rent, around 1212, compensation from the landlord without showing any evidence of my financial loss0 -

Most bank transfers are faster payments now, you should have got your money within two hours not several days. Do you have a copy of an assured shorthold tenancy signed by yourself and the landlord? If so you are BOTH contracted until such time as a deed of surrender is prepared, if they don't let you move in and have let other tenants move in they are in breach of contract. If your landlord or his authorised agent didn't sign an AST you have no claim against them. You might have a claim for compensation against Foxtons, depends on the specific scenario of being let down. If they thought they had sole agency and had authorisation to sign an AST on the landlord's behalf the agency may be able to claim their losses from the landlord.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0
