Apologies first, if this is in the wrong forum section.
I just wondered if anyone can assist with a query I have over a contract.
If a company who I am in contract with cannot provide a copy, are we in contract or not?

well did you actually sign a contract, do you have a copy of the contract.

My thread was a bit vague - apologies.
In answer to your query, the person who arranged the contract has left and no, we don't have a copy.
The company who we presently deal with took the business over from the original company with whom we made the the agreement.0 -
Im not sure of the law but dates matter too.
I have seen posts on the board where a reconstituted contract is acceptable in law.
Is it a loan agreement.
More people will be along, possibly tonight when they get home from work but your posts are still a bit vague.

It is not a loan agreement & I am sorry to admit that I don't have any idea of the date - a few years, I think0

Without a contract it may not be enforceable in a court of law but if it is one that is reportable to the CRAs they could trash your credit rating for failing to pay. You need to be more specific.0

A contract does not have to be written to be valid.
For example if you ask a plumber to repair a burst pipe you still have to pay them even if you never signed (or even saw) any written terms.
If two parties have acted in a certain way as if a contract existed the courts will generally accept that it did exist.
The paper documents only become essential if there is a dispute about some point which isn't obvious or if it's a regulated area like credit, where written agreements are a statutory requirement.We need the earth for food, water, and shelter.

Thanks all. I appreciate that I haven't given you all the required info for which I apologise.
Using the advice you've offered to date, along with a chat with a solicitors, I am trying to come to an agreement with the company, hopefully with a positive outcome.
Should I need any more assistance, I'll return.
