    Why did you refund the deposit, why didn't you just protect it? The letting agent is not liable for protecting the deposit you are. Why is your tenancy agreement for a year and a day? What do you mean by 'another notice'? What do you mean by the only option is the courts? You have not served an S21 and they have not refused to vacate yet.

    ..I was wondering that too. The agent sounds useless.

    Because he still would not have been able to serve a S21, the localism act is quite clear that unless the deposit is protected within 30 days of receiving it, a S21 notice is not valid until the deposit has been returned.
