Buyer not responding

I sold some trainers on ebay 10 days ago in 'USED' condition, buyer was not happy with the trainers and said they were not as described, they had been used twice only as said in listing, so they contacted me and I said I would give them a refund excluding p&p but they filed a dispute in paypal and I have only 2 options,
1- Refund ALL the money (which I dont want to do because that would mean I am losing out on the p&p
2- I would like to end communication and escalate this dispute to a claim with PayPal
I have contacted the buyer 5 times in the last 10 days and they have not responded to me. I am very sure that buyer is ignoring my messages. This dispute will close by the 9th of april, any ideas on what i could do, and what happens when the dispute closes?

The buyer can escalate the claim to a full chargeback at which point paypal will make a decision as to whether they agree with the buyer or the seller in the case. If they find for you then paypal will close the dispute and you keep your money, if they find for the buyer then the buyer has to return the trainers to you and paypal willr efund them the full payment originally made. Regardless of the outcome the buyer can leave feedback for oyu on ebay.
With used items paypal tend to slightly favour the seller, as the definition of 'used' can vary a great deal.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. whatever you do please make sure that all communication that your having is recorded within the paypal dispute console. i.e, offer to refund - p&p. on receipt of returned items.Give blood - its free0
