I'm sorry but I don't agree that an e-mail is good enough - I repeat my previous advice to write a letter to the senior partner setting out your inability to pay. They have billed you for disbursements and your agreement allows the firm to bill you as the disbursements arise.
I'm concerned about the way that the adviser has handled your case ie the agreement sounds v. poorly drawn up and you have nothing in writing re who is to pay the disbursements. This is not a professional way to be carrying on. If the ET decision goes agaisnt you, you must consider making a formal complaint to the Legal Complaints Service about the way that he handled your case.0 -
Some good advice here Bikebarbie..don't borrow trouble, and if it should go against you then it's time to speak to complain. You pay for professional advice, not to have your case timed out when you approached for that advice in a very timely manner. He's the expert, he knows the time frames. That's what he's paid for.
And don't worry about upsetting him. It's not personal when it comes to money, it's just business, and providing you are pleasant to him as a person when you speak to him, he'll understand that. Business people do understand these things. Please don't worry yourself about that part of it.0 -
Following to all the good advice here I am writing a letter today. My legal adviser is on holiday this week so I guess I ll get an answer (or a phonecall) soon after easter monday. Please dont think you are getting rid of me, I will still need your support and I will most definitely keep you updated and write back as soon as I get a reply.
SILLY IDEA: MSE should have a charity set up because for example I am so grateful for all your support and I would have liked to show you all my apprecciation by giving you something but since it would not be possible if a MSE charity was set up every member that received invaluable help could give a little back ( an a little from many people would make such a difference)0 -

Hello just to update everyone who has adviced me on this matter unfortunately I have been informed today by my solicitor that I have lost.
I am so upset and actually feel sick about this result.
The solicitor told me that they are doing this as a no win no fee so I wont have to pay that massive bill I accrued whilst I pursued this case but the fact that I have lost because they think that the issues / detriments I claim to have suffered they dont think they are detriment and for this reason my last detriment that they consider falls out of the timescale of my Tribunal Application and for this sole reason I have lost, not because my case was not strong but just because of the solicitor negligence AARGHHHH!!!!!!!
I feel so angry inside I have been told that they will ask the Barrister if it's "worth" it going to appeal but there is "little chance"
The deferred decision took almost 4 weeks over the due time and I was fooling myself thinking that this may mean that it was a positive outcome NOT!
I can t believe it after all the Company have done to me and all their Milliions profits they have treated me like that and WON! Where is the justice in that?
This is infact an abortion of justice as a technicality - has come between who is right and who is wrong.
I cant let this rest, can I write to the Chairman? And if the solicitor wont do the appeal can I appeal by myself. I just cant believe this has happened.
If you were in court that day you would have loughed at how the Chairman was ranting at the defendant for being so unprepared and when they were lying and digging themselves in a big hole and still he let them win AAARGH

I know that you feel upset but I am actually a Law graduate and going for my paralegal qualifications at the minute.
Just wondered if you have considered appealing the decision made by the employment tribunal. Also this time you can change your solicitors if you want so you might be able to get legal aid but I am not sure on this point.
Anyway you can make an appeal if a point of law is in question. why don't you ask for a copy of the summary of the case and the outcome. The website www.employmentappeals.gov.uk seems to have some information in it.
