I would tend to agree.
Normally damages are not awarded for non pecuniary loss. The exception are contracts where the purpose is enjoyment or happiness. A wedding dress would seem to fit that requirement well at least until the divorce

I'd agree though - a wedding dress is designed to be worn once but create lasting memories. The lasting memories should not be of something which was constantly in need of fixing throughout the day!
In your position OP I'd ask for compensation beyond simply cleaning and boxing the dress (that's lost revenue to them of, say, £150 maximum against a £6k dress - and far lower lost profit!). I think I'd be expecting some money to be refunded against the price of the dress, which should really have been better quality (my wedding dress cost just over a tenth of the one you're talking about and was just fine throughout the whole day!).0 -

interesting post..I am in a similar position. My Wedding dress was falling apart before I even put it on. And all throughout the process I had problems with the company, issues like holes in the dress, stains etc. I contacted CAB a few months before my wedding as I was worried about the service and quality.
After several letters which were not well received, I am suing them in the small claims for Loss of enjoyment.
It amazes me that people get so riled up over a three year old sofa, but a wedding gown, which costs Thousands, and should last for 30years+, people chalk it down to experience.
Under the goods and services act 1982, the normal practice would be to replace or repair the item, however, as the time for wearing the dress has passed, there is little point in this, so they should reimburse you for loss of enjoyment.
Don't let anyone tell this poor girl that she is being silly, she spent a fortune on this item, and should have received the proper service.
I am not turning my wedding into a legal battle, I am complaining against a company who time after time take womens money and fob them off with a shoddy service, knowing that they do not need repeat custom. They rely on the fact that people don't want to mar the memory of their wedding day, but unfortunately, they did that for me, so i've little to lose here.
