If I forget about my claim I was mis-sold, do you think I should take the my case to the ombudsman about the rejected claim? If it was not the sentence I highlighted in my initial post that formed the basis of my rejection, how about the sentences in italics in post #6 of this thread?

I think they've applied the cover wrongly. Even the best travel policies won't usually cover you for valuables left in luggage, so their description of the quality of cover probably doesn't constitute mis-selling.

The requirement for reasonable care (in italics) is, I imagine, what leads Bob to believe that the valuables won't be accepted.

I'm pretty confident though that the FOS would recognise how common it is for a hotel check-out to be earlier than a flight time, and that it's fairly common to leave luggage in the care of the hotel.

What you shouldn't do is acknowledge to the insurer that you were given the option of keeping the room for an extra £10, that you realised that your luggage would be more secure there, but decided to risk it rather than pay. That would allow them to decline the whole claim.

Edit: Edited to say, if you really think you were mis-sold there's nothing to stop you pursuing it while challenging the claims decision. It's just likely to be a waste of time.

Appreciate that, no option like that was ever offered. Will proceed tomorrow with the FSO.

Thank you all for your insight into the matter. Will bookmark this thread to update you in the future of any outcome.

Have you taken into account the inner limits the Insurer impose for the total amount of valuables, the single article limits and any deductions for wear and tear in your estimate of the value of your claim?

Not fully but the insurer had never asked for that, just an inventory of items. My claim was rejected pretty much on the spot. I have estimated based on price to purchase new.

One item is a laptop worth £500-£600 to replace. My policy will only cover a maximum of £300 which I will take into account when I need to provide an exact estimate.

It's their job to apply the limits to the claim, not yours.

I've a feeling dacouch was tipping you the wink to the fact that, having been advised that there is a doubt over whether valuables will be covered, you could ensure the non-valuable items come to as close to the £1,500 as possible...

Or I could be mistakenly, horribly defaming him...:A

They should have told you why it was rejected. Its not for you to guess why it was rejected.

If you disagree, you complain. If they stick by their rejection then you can go to the FOS.

ps Do you have any cover under your household insurance?

I was told it was rejected as I left my bag with a 3rd party out of my control. They didn't not specify chapter and verse what part of the policy they refer to in backing up their claim. Will seek this info for the FSO

Definitely worth checking if you have included personal belongings/possessions with contents cover.

Will probably be a higher overall limit, a lower standard of reaonable care for valuables, and a tighter definition of the valuables.

Also, probably a better trained claims staff.
