Council tax benefit

In 2006 I lost my job and was in JSA for short period do received council tax benefit.

This year I started receiving demand to payback overpaid benefits. About £1500. In January I called them and asked what is this about and the reply was its system generated and the account is upto date.

Last week balifs came around and wanted payment for an address I lived in 2006 so they went back saying its over 5 years old so they don't deal with this.

Can someone help on this please it's urgent. Had to pay up £600 to get them out of my house.

    You need to go back to the council and ask them to provide evidence of what you owe (or not as the case may be). Bailiff's cannot visit you unless the council have been to court to get a liability order, they then instruct the bailiffs to collect the debt.

    If this is all a mix up the council will be able to advise you of this and recall the debt from the bailiffs, if it is not a mistake you will need to set up a repayment plan (and stick to it otherwise further bailiff charges will be applied), you may want to speak to a debt/money adviser at a CAB/similar.

    Yeh first time they went. Then came back after a week.

    personally i would send the council a subject access request they have up to 40 day to reply to this request and it may cost you £10 (some councils charge for this some don't) however as its your financial history you want i don't see why they should ask you to pay for this information

    what council and bailiff firm are you dealing with ?

    start by asking the Council.

    1 - how many Liability Orders they have against you
    2 - the dates they were obtained
    3 - the addresses they were for
    4 - the period of time each covers
    5 - how much each one was for
    6 - how much is still outstanding
    7 - the dates they were passed on for enforcement

    send this to the council and the bailiff firm (can be done by e-mail if posting send recorded delivery )

    Dear Sir
    With reference to the above account, Can you please provide me with a Breakdownlink3.gif of the charges.
    This includes:

    b - the reason for the fee.
    c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.
    d - the name(s) of the Court(s) the Bailiff(s) was/were certificatedlink3.gif at.
    e - the date of the Certification.
    This is not a Subject access requestlink3.gif under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.
    I require this information within 14 days.
