  • That is the normal process with councils, has been for years wrt to what is homeless and what isn't. I'd been given notice to leave by my last landlord and was on the homeless list with the council. My council told me to stay put and that I was doing nothing illegal by being there, just pay the rent and wait for the court process. Fortunately the council found me something part way through the process. Baillifs don't just turn up and turf you out, you get written confirmation of the date and time they will arrive so there is plenty of time to arrange to move out by that time and then the council know the date they have to sort something so it won't come to you being there when the baillifs turn up.
    However most councils don't place homeless people in council properties as so many people were manipulating the system to jump the queue. They normally find you a private rented place and place you there but the difference is, they rent these places from the owners and your lease is with the council but it's a normal lease like with a rental agency. They have to find you somewhere that costs under the LHA and another bonus, no rents in advance or deposits needed and any repairs the council do.

  • Wow! Thanks for that PippaGirl! We just really don't want to cause anyone any hassle. In the end they renewed the lease and I have a feeling that unless he sells the place, they'll let us stay here indefinitely even if we didn't sign the new AST, which is not what we want. They won't want the hassle of going to court. Let's just hope that he wants to sell soon!

    Can I ask what you mean by an early discharge.
  • If you have as simple straight forward case that the OR can comPlete in a short period of time the he can begin the discharge process early so you may not have to do the full twelve months. Though with the work load they are now under they tend not to happen nowadays. We used to get two or three a week on the board and now we are extremely lucky to get two a month on here.

  • Hi Lizzy - Thanks - and early discharge is as per TigerFeet's post above.

    TigerFeet - When I had the phone call with the OR, I asked whether it was going to be investigated and do I need to send him anything. He said no as it was all straight forward and there will be no IPA as I'm unemployed, so hopefully I'll get an early discharge! Will let you all know in a few months time!!

    Just to let you know that I didn't get an early discharge as some of the debts were incurred within a year of me becoming bankrupt.

    Vanquis gave me a credit card a week after I was discharged - this is to rebuild my credit rating and gets paid off every month - I'm not falling into bad habits again!!

    Hubby and I are sticking to our budget (he's still in an IVA). Things are tight, especially with a little one, but only three and a half years and we may have some spare cash!!!
