Going Bankrupt Tomorrow at Medway County Court - Advice Please!!

Hi,

I have an appointment tomorrow at Medway County Court to petition for bankruptcy. (I called them last week to check that I could just turn up and they said no, I have to make an appointment). Has anyone done this at Medway recently and know how this particular Court will deal with things?

I have the forms (in triplicate), the fee and a copy of my AST. Can anyone recommend if there is anything else I should take with me? (i.e. Do I need any ID, would you advise taking copies of my Maternity Allowance letter showing my income, or copies of bank statements etc)

Also does anyone know how long this will take? (I'm eight months pregnant and need to get back for an appointment which I can't reschedule).

  • I don't really know, but I didn't want to read and run!

    I know I took ID and bank statements, but that's because I was claiming the reduced fees, and you need proof. If you don't get a more knowledgeable answer before tomorrow, I would suggest take everything - better to have it and not need it than the other way round.

    And congratulations! First on your baby and second on your bankruptcy - you'll be stunned at how much of a weight is lifted off your shoulders when you leave the court room tomorrow xx

    I'm scared about tomorrow, but know it's for the best (and my only option!!!!).

    The challenge after that is finding somewhere to live three weeks after the baby is born as we can't stay in our flat after then! Kind of pooping it about that as we don't have a guarantor or the funds for six months rent deposit. We'll fail the credit checks anyway as I'll be bankrupt and the husband is in an IVA.

    Photo ID is needed, something that links you to your address such as a bill. The only other thing you need is proof of eligibility if you are applying for fee remission. Otherwise all other things like bank statements get sent to the OR afterwards not on the day.

    I was in court about 3 hours in total, and I know from reading here that although some are there much less time, three hours is not unusual.

    Just to let you all know how it went on Wednesday:

    Saw the clerk at 9.30, signed my forms whilst he checked them (he was very nice). This took about 15 mins.
    At 9.45 I took my file downstairs to the court usher (who I thought was a receptionist). She said that she will do what she can do to fit me in to see the judge but they were busy and it may or may not be a long wait.
    One hour later, she came over to me and gave me my file and said that I was lucky, the judge dealt with it on paper and that it was all done, I just had to take the folder back upstairs for the order to be written out.
    10.45 I took the order upstairs and was told it would take at least half an hour, possibly more. It took fifteen minutes!
    All in all was in there an hour and a half. Everyone was friendly and helpful, just wish I'd done it ages ago!
    I didn't need ID, just the forms and the money - but I'd take it just in case.
    I was told the OR would contact me in 48 hours, but haven't heard from him/her yet.

    well done wish you all the best. Have you contacted any local housing associations they maybe able to help re housing especially with a baby on the way.

    Yes, we've been registered with the council for months, and we have to go through the homechoice website thingy but we're never eligible for anything, but will be once the baby is born apparently. I am going to go to the council offices during the week as I think they have to sort something out for us quite soon as we're going to be homeless within two months?? Not completely sure, but we're going to go and see anyway!

    Had my telephone interview with the OR and it all went smoothly. Was asked a few questions on how I got into debt and that was about it! I won't have an income order thingy as I'm now unemployed receiving only maternity allowance.
    I asked about early discharge, and he said that he doesn't think I'm down for it, but I'm going to call them in a few months and ask again.
    All in all, the whole process has been so quick and easy and I wish I'd done it last year!

    With our housing situation, our lease was due to expire at the end of October and we didn't think we could renew it due to further credit checks needed which we knew we wouldn't pass. We informed the council that we would then be homeless and they said that we would be making ourselves intentionally homeless if we were to leave the property and to wait for the landlord to take us to court and evict us for not having a lease. So with a one month old baby, they wanted my husband and I to go through the stress of him being at work and bailiffs turning up to turf me out whilst he's not there! What is all that about? This country is going to ruin! All we need is a bigger place to live where we're willing to pay every single bill and the rent. Just somewhere affordable. All of the private landlords charge through the nose, so we're going to be cooped up in a tiny one bedroom flat for the next six years, until the bankruptcy is off of my credit file and the IVA off of his. As you can guess, we are both so angry that we're not entitled to any help from the council despite paying tax and NI for the past 16 years.

    Anyway, sorry about that! Rant over!

    Thanks for all of your help whilst I've been going through this! Will let you all know if I get an early discharge!!
