Ebay claim times

Hi, I know that the claim period for paypal is 45 days, is it longer for a claim through ebay? I purchased an item at the start of July and its been okay, but tried to use it yesterday and it has broken in two places, it looks lke a manufacturing fault as it is anitem which has metal bars held by rivets and it looks to me that the rivets were too tight and they have caused the metal to wear and snap 
I have contacted the seller and their terms state that they don't accept returns, they are a business seller but if they are going to mess me around then I would just rather let ebay decide the outcome. The item was around £100

You have additional legal rights that can be enforced outside eBay - you don't have to adhere to eBay's deadlines, though it's a bit less simple 45 days out. But if you state your case firmly but politely, they might see sense. A small claim would cost £30, but given the law involved is firmly on your side, those costs would be awarded to the seller.
