    Usually on the account closure forms there is an option to tick to keep the bonds until they mature

    I was given that option for one of my dad's bonds with the Nationwide. It was a good rate of interest and I would have liked to leave it as I am not in need of the cash. However, I intended to buy my brother's half as he wanted the money. There was no facility to make the proceeds just for me and although I trust my brother implicitly, I could see all sorts of pitfalls for the future. What if I died?

    In the end, it was cashed in.
  • Can I send a letter to the solicitor asking for the detail of when the will of my late father law was written , who was present etc, do I have to head it Larke v Nugust. Or do I have to get a solicitor to do it
  • If probate has been granted, you could get a copy of the will from the Probate Service

    Just a quick question. My dad died back in December, he did'nt have a will. The house which we thought was his turns out to be my mums aunts(posted about this on another thread) so basically he had no estate. We have'nt been issued a death certificate yet(waiting on Coroners Court) so just have an Interim Certificate. Do we still have to go through probate?

    On the other thread you're saying the house was owned by your Dad.

    Until you find out exactly what the position is to do with the house, you won't know how to proceed.

    Sorry Mojisola did'nt meant to get wires crossed regarding the house, it just seemed pointless typing the other thread out here in full. In the other thread I said it was'nt owned by my dad but my mums aunt according to Land Registry.

    So I don't need to do anything? I could see this dragging on for a long time!

    Usually if the estate is below £5k, you don't need to go through probate.

    You need to find out what happened to your aunt's estate. Talk to your cousins.

    All the probate office does is check you are who you say you are and you have the right to administer the estate.

    Once they are also happy that HMRC are happy or you declare an excepted estate with a IHT205 they will issue the grant.

    HMRC checks the tax often with a quick glance through what you declare on the forms and the response to the r27. they sometime take a closer look, more likley if there is IHT to pay, if no where near there is little point, they may question a property valuation.


    NO ONE has a job to check you then do it properly.


    Remember if you do get it wrong and someone(eg benifitiary) finds any mistakes you are personaly liable to correct them.

    Only if the beneficiary can afford the expensive legal fees. The probate office will not do anything...

    My Mother in law recently died and all she has is £17K in 3 Barclays accounts in her name, funeral costs will be £2.5K and the local branch of Barclays told us initialy that this would be taken off and £14.5K would be below their threshold for probate and they would release the funds. Later they contacted their bereavement team who said funeral costs could not come off and as the estate was above £15K at death we would have to go through probate. This seems totally illogical as everything else I have read about probate says that the funeral costs are debited from the estate.

    Could anyone with knowledge of this area please comment and any suggestions as to how we get Barclays to take a more sympathetic view and use some discretion at this difficult time would be welcome.
