Do we need these permissions/consents??

Hi,

This is my first post on this forum and reading some of the threads already has calmed me down a little. We are in the middle of a 3 house chain and 8 weeks into the legals etc. Up to yesterday it was a four house chain but our vendor pulled out on his purchase and said they will move into rented.

4 weeks ago our solicitor asked for some papers following receipt of vendors information. Hardly any of these have been located yet and I think this was a delayaing tactic on the part of our vendor in order to get his purchase lined up (he started his legals a couple of weeks after everyone else). As he has no reason for the delay now I'm wondering whether we really need what my solicitor asked for.

In summary the house was built three years ago and has not been altered since then. It was built by a well known national housebuilder. The papers generally relate to planning permission/ building regs consent/ and consent to building the property under covenants from previous transfers of the land on which the house is built.

Given that the house is in an estate of over 100 built at the same time, it is surely inconceivable that permission/consents were not granted, I'm thinkng that we can proceed to exchnage without this stuff given that the risk must be negligible. Do you think the solicitor is being overcautious?

    As you are probably buying with a mortgage all these consents will be required as a condition of this - and even if you don't feel the need for them your buyers will probably want them when you come to sell, so your solicitor is not being overcautious.
  • Thanks for that but I have a couple of questions:

    1. I don't remember our solicitor asking for planning permission details when we bought the house that we are now selling - does the fact that the house we are hoping to buy is only 4 years old (and the one we're in now is over 40 years old) make any difference?

    2. The local authority search shows that planning permission has been granted - does he need to have a copy of the actual permission itself?
