    I spoke to the Barclaycard my Credit card company and they said i can't make a complaint about the transaction until it has changed from pending to actually be a debit on my card on the 6th September. When this happens I can then get it investigated. This seemed very perculiar to me as surely they would want to investigate it as soon as possible!

    One thing I'm worried about is if i try to sue them without a solicitor could I end up messing it up and incur more costs? As The £180 has pushed me over the limit let alone if i was charged any more. I really think people should earn a honesty days living this just feels like they've mugged me of my money!

    I will try and get the receipt scanned and post it up later on.

    You can use the HM Courts & Tribunals Service Money Claim Online service. For £180, it would cost you £35 and you get this back when you win. I've used it twice and both settled out of court at the last minute. It's an inappropriate analogy, but it's criminally easy.

    The credit card company is plan A, the above is plan B.
    The acquisition of wealth is no longer the driving force in my life. :)
  • You have been legally mugged. The trick now is to get your money back as quick as possible, this is undoubtedly the charge back route. However you will be fighting an uphill battle. If they have not explained to you (to your satisfaction) why the can't hold the payment until they have finished their investigation or you';re unhappy with the explanation then DO make an official complaint. By law they have to investigate. If you exhaust their complaints procedure you can then Write to the FSO, who will instigate an investigation (costing the CC provider a minimum of £500 - win or lose).

    Remember these Grunts are the CC providers Agents, and they (the CC) ARE also liable to the legal action you WILL be taking in conjunction with your attempts to get the payment stopped.

    You will get loads of help here (and Pepipoo if you post there as well) to ensure the best outcome for you. You action should cost liltte more than £35 which is the court fee and is allowed as part of your expenses which will be returned when you almost inevitably win). You will have to spend some time making sure you understand the arguments fully, and here (and the other place) are a fund of information and wisdom for you to draw on.

    So plus VAT, are they in fact VAT registered? Did they give you a receipt with a VAT number on it? If they are not you can possibly use this to get your money refunded as its illegal to charge for it if you are not registered.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Yes £180 was including VAT. How would I go about finding out if they are vat registered.

    The receipt for £150 + VAT must have a VAT number on it, otherwise they cannot charge it, so you are saying then there is no number on it?

  • The receipt must legally have the Following:

    Company number (if trading as a limited company) - complaint to companies house if not present.
    VAT Number - if charging VAT this must be present (and be correct - one PPC has a habit of putting Barclay's bank VAT number on theirs), if not present of incorrect this is fraud, which HMRC are *very* interested in hearing about.
    An address (preferably a registered address) where legal documents can be served (so not a PO box - there are very few exceptions to this, and if persuing legal action the PO will tell you what is registered).

    All of this is diddly squat however, unless you include the landowners in your action, the Grunts probably line their walls with their CCJ's.

    I now know I shouldn't of parked there but it wasn't very clearly marked not to

    Slow down. What evidence do we have that there was anything untoward here? Why did you think you weren't allowed to park if the signage wasn't clear?

    If there is clear signage and the SIA receipt contains the required information, a £180 clamp release fee is a tad on the steep side but probably reasonable in 2012.

    We need to see photos.
