Ford Credit underwriters in 1993

Hi there - did anyone take out a hire purchase agreement with Ford Credit in 1993 and still have their policy booklet that gives the underwriter details - I only have a copy of my agreement and I can't remember if I even received a policy booklet. I'm trying to claim back PPI which I know was mis-sold to me. Ford Credit say they no longer have my details so sent of my complaint to FOS. They say as Ford were not a member of either GISC or the MCCB, they cannot consider a complaint against it, but I may be able to claim against the underwriter of my PPI policy - so if I provide the underwriter details they will access whether they can set up a complaint against them. Thanks

  • Neither the General Insurance Standards Council nor the Mortgage Code Compliance Board existed in 1993 so they could not have been members at the time (though I have no idea what relevance the latter is supposed to have with a hire purchase agreement anyway).

The underwriter has no case to answer as the policy was sold by somebody else.

In theory your complaint would be against the dealer but they can simply use Section 14B of the Limitation Act 1980 to timebar you.

Thanks for replying magpiecottage - so I wonder why the FOS wrote saying that. I've now written again to Ford Credit asking although they may no longer have my agreement details, they possibly could tell me who their underwriters were at that time.

They wrote that only because it MAY have been an option.

As Magpie already said, this will simply be time-barred as too old.

The FOS seem unable to be able to just say 'No' - they always like to cover themselves by leaving a chink of light still visible, even when everyone else knows that the case is a hopeless one, despite the fact that such advice then goes on to continue to waste everyone's time, including yours.

Whether or not this comes from a complete abdication of accountability on the part of their staff is of course open to conjecture.......

My Ford PPI policy documents from 1995 and 1997 state the underwriters on each occasion as Consolidated Life Assurance / Consolidated Marine General Insurance (see my separate recent threads). Hope this helps (although as it was pre-regulation complaints are unlikely to get anywhere).

I doubt it, this thread is almost 10 months old and the OP last logged onto this site in December 2012.
