Dress damaged after one wear, rights?

Hi, trying to find information on my consumer rights. I bought a dress last week for my friends wedding which was yesterday. After the ceremony when we sat down for the meal I noticed there was a loose thread on the front of the dress. The material being silk it has pulled and left a line right across the pattern.

I hadn't been bosterous, just been walking and sitting so I'm really annoyed this has happened. I intend on taking it back to the retailer. But I've heard that they can be very funny about returns, especially when it concerns damage and wanted to know what my rights will be since I've worn the dress? Thanks.

    Me too, I'm afraid, silk dress, the last thing you should have done is pulled it.

    Can yu try to pull it back the other way. Or is it 'out'

    What retailer? And how long ago did you buy the dress?

    Some retailers are very fair with their faulty returns and will exchange for you.

    I think the onus would be on you to prove the dress was faulty in some way rather than you having accidentally caused the damage yourself. So unless you're 100% sure that it wasn't you...well, you'd still have to convince the retailer of this tbh, which will be practically impossible given that you've worn the dress.

  • I didn't pull it, not sure how it's happened. But if I do anything to fix it, cut it etc it will leave a hole. I bought it a week ago, and hung it up in a dress bag until yesterday. Thanks for the replies. I don't think I have much chance either. C'est La Vie.

  • I've taken a dress back before that I had bought for a christening and it started to fray all along the hem and further up the dress after being worn once.
    They happily exchanged it for me without even inspecting it all way round. They even refunded difference in price as it had since gone on sale.
    I think that as I was asking for exchange rather than refund they were happy to exchange without further questions.

  • I sent a dress back to Littlewoods after wearing it due to a faulty stitch around the bust area (was actually quite embarassing wearing it.) and they refunded straight away because there should have been more than one stitch :)

  • In the first 6 months the onus is on the retailer to prove that the item has not been damaged in the first place. So, if you ask for a replacement, they have to prove the dress was not damaged when you bought it.
