0% interest balance transfer letters

Recently, credit card companies have changed the marketing letters for 0% interest on balance transfers to 'rate information' or 'new rates for your card' (with balance transfers in the blurb).
Card providers say this is not marketing but servicing on the account so can send as many as they want per month.
Has anyone had successful decision about these at the Financial Ombudsman ? Replied please from forum users with actual experience.

I don't see these as marketing at all. They are notifying you about something that's available to you on a product you currently have.

This would be like you trying to say that a letter from your bank about varying the terms and conditions of your account as marketing?!?!

If they are changing the rate applicable to your card they a required to notify you.

I don't see the problem with this, I had one from Virgin today.

Possibly changing contact preferences, might help prevent some mail. I seem to remember saying I was happy for Virgin to contact me by email and letter, but not phone.

My letter was headed in big lettering, New rates for your Virgin Credit Card, so I guess it is as opinons4u says changing rates applicable to the card, so they are required to notify people.

I would hardly call it marketing though and am amazed that someone wouldn't want to know about new promotional rates.

Sadly my letter today was just for balance transfers and money transfer for 12 months, but as I have no balance to transfer it was useless to me. Hoping to get a 0% purchases in the next letter.
