Tenancy agreement witness signature

I suspect that my Landlord used a family member to witness his signature on my Tenancy Agreement. Is this legal?

Tenancy agreements do not have to be witnessed (or even written - they can be verbal) in England & Wales unless longer than (??) 3 or 7 years....
In Scotland all tenancies MUST be written, signed & witnessed.
AFAIK anyone can witness, but the issue is would the evidence stand up in court if it ever got that far.. If I need a witness I always try to get someone unrelated to all other parties, but not afaik essential
Presumably in your case anyway you all agree what the property is, start/end dates, what the rent is, how often it is paid etc etc so probably not an issue...
Was there a particular problem behind your question?? Anything else you think maybe not legal (Gas safe certificate, any landlord insurance, agreement of mortgage company to rent out, does he declare tax, does he need a license (some areas, many HMOs...)??0 -
He is a dodgy character with Sell and Rent Back properties (ours being one). At least one has been reposessed. I now suspect that some of his family members use different names. Why would people do this unless they are working some sort of scam? I think he is one step away from Bankruptcy, so I'm naturally worried about our legal rights.0
