Without Prejudice Offer

A third party recently hit my parked van and it turns out the third party had a stroke at the wheel.

The third parties insurance company initially said it was an act of god but then after several phone calls they said they would offer a "without prejudice settlement" which i have now received.

On the letter it states "this payment is made without prejudice to liability"

The main problem for me is that my insurance expired last week and when getting quotes for a new policy i was told by many insurance companies that the accident would be put down as a fault accident until liability was proven..

I was lead to believe that after receiving this settlement i could put down that i was not at fault for the accident but this comment as above makes me think otherwise.

My quotes originally were around £450 for my van but when putting down that i am liable for the accident my quotes are around £2000.

Can i legally now put down/say that the accident was not my fault?

    Yes.

    Fault in this context refers to whether your own insurer paid out. Yours hasn't, making it a non fault claim.
