Help redundancy query

Hi my husband received a notice of redundancy from his emPloyer stating that his duties would end on 31st August. His employer was never forthcoming with information regarding pay at the end of his notice period. My husband worked there for almost 11 years & gave his employer a letter requesting pilon for the extra 7 weeks he had not received of notice. His employer has told him today.... 1 day until his notice has been fulfilled that he will not be paying him 7 weeks wages to sit at home & if he had to brush the yard for 7 weeks this is what he would do. He obviously does not want to pay pilon & told my husband this. Can he do this the day before my husband was to be made redundant, my husband never had a contract of employment as this employer just doesn't believe in them. Please advise can my husband tell his employer that he has worked his notice as requested & will leave tomorrow as planned:mad:

    The employer can indeed do this. He doesnt want to pay him for staying at home and that is fair enough. On the other hand if your OH wants to leave tomorrow he has to forfeit the pay for the next 7 weeks.

    He is entitled to 10 weeks notice either working it or PILON, the bosses choice.

    Any accrued holiday pay.

    10 weeks redundancy pay (for each full year over 41 yars of age it is 1.5 weeks for each year. (capped at 430£)

    If the boss man doesnt comply take him to a tribunal but check facts with ACAS first.

    Thanks mckneff but why send a letter of notice to all employees & tell my OH that this will only be the case for him. Also if my husband secures another job before the 7 weeks will he still be entited to his redundancy. There are 5 people working for the cOmpany

    He is entitled to redundancy regardless of anything.

    Have a look on the .gov website, its very interesting, you will get all your answers there.

    As for all the letters, It may be just the very nature of the different jobs, length of time others have been there etc.

    Can u tell me is his redundancy based on his final weeks pay or is this on the pay he received over the years

    When was the notice of termination due to redundacy given?

    What are the terms of the contract contactual hours and payments.


    What start date is being used for continuity of employement and service, ,is this correct?


    These will start to put a picture together, holidays come next


    if the contractual hours are variable it could get complicated.
